Moser threatens to sue city
Charles Moser is ready to sue the City of Humphrey.
During a public hearing April 2 at the Humphrey Community Center on the Comprehensive Plan and new Zoning and Subdivision Regulations, Moser said both violate the state and U.S. Constitution and he will sue to stop them from becoming law.
The comprehensive plan and zoning regulations were recommended for passage after the hearing. They now go to the Humphrey City Council for final approval at its Monday, April 15, meeting. The council convenes at 7 p.m. at the community center.
During the 5-minute comment period, Moser asked how unelected board members can make laws.
Keith Marvin, of Marvin Planning Consultants, of David City, who was hired to help develop a comprehensive plan and zoning regulations, said they are not making laws, but Moser argued that point.
