Judge denies motion to dismiss case; sends lawsuit back to district court
A federal judge has ruled a whistleblower retaliation lawsuit filed by a former school counselor against Archangels Catholic High School belongs in Nebraska state court, rejecting the school’s attempt to keep the case in federal court.
In an order filed July 31, Senior U.S. District Judge Joseph F. Bataillon granted plaintiff Melissa Braun’s motion to remand the case to Platte County District Court and directed the federal clerk’s office to close the case. The judge also denied as moot the school’s pending motion to dismiss.
